Florida Gold Exchange sources many products on a just-in-time basis. In rare cases, a specific product ordered by a customer may become unavailable after an order is confirmed. When a suitable equivalent exists, we may offer a substitution rather than canceling the order.
A substitution must be of equivalent type, weight, and purity as the originally ordered product, and of comparable market value. Examples include:
We will not offer a substitution that materially changes the nature of the product - for example, substituting a coin for a bar, or a different metal entirely.
We will notify you of any proposed substitution before fulfilling your order. You have the right to:
We are under no obligation to offer a substitution. If no suitable equivalent is available, or if we elect not to offer one, Florida Gold Exchange may cancel the unavailable portion of the order. Refunds, cancellations, exchanges, and any other remedy will be handled under the written terms applicable to that transaction, which may include the customer's invoice, receipt, quote, order confirmation, posted or provided policies, and, for larger transactions, any signed Sales Agreement Packet.
If Florida Gold Exchange cancels because it cannot provide the ordered product or a suitable substitute, no cancellation fee or market-loss charge will apply unless the customer's separate breach, failed payment, dishonored payment, refusal of delivery, or other failure to perform caused a separate market loss under the terms applicable to that transaction.
